Risk Analysis and Management
Almost no notification to a professional strikes more angst and trepidation than the announcement of a government proceeding affecting one’s reputation and livelihood. For the entirety of our existence, BGGP has vigorously defended the rights of our clients against the often heavy-handed proceedings of professional discipline. Our staff has represented our clients in all phases of professional discipline: preliminary written response; informal review conferences; formal hearings and appeals. As with many other types of professional litigation, our paramount concern is the most effective and efficient method of successfully resolving any allegations that may impair our client’s license, ability to practice and standing in the community.
Our team has presented in-house educational programs to physicians and hospital staff in an effort to aid our clients in the identification of potential litigation hotspots, methodologies of reducing the risk of litigation, and rapid responses to unintended results that may reduce litigation. Our presentations also focus on the legal issues of the EMR, record preservation, HIPAA and, going forward, the Affordable Care Act. Simply stated, when our clients come to us they have the confidence that we are experienced advocates and, most importantly, that they are not alone when dealing with regulatory agencies.
