Appellate Practice

BGKS has successfully argued appeals and dismissal motions in the state and federal courts throughout New York.  Our appellate attorneys are skilled at drafting persuasive briefs and are always well-prepared for oral argument.  The fundamental philosophy of our appellate advocacy is meticulous review of the facts, an intimate familiarity with the relevant law, and critical analysis of the intersection between these sometimes competing subjects.

To avoid having our clients subjected to an appeal, our trial attorneys regularly consult with our appellate experts when legal issues arise during the pretrial and trial phases of litigation.

All of our attorneys are aggressive in their pursuit of motions for summary judgment before trial, as we make every effort to save our clients the time, expense and emotional commitment of a trial. Should a trial be necessary, our appellate staff stands ready to prepare and defend trial and post-trial motions, in an effort to protect and preserve the favorable aspects of any verdict or ruling.

RECENT APPELLATE VICTORIES:

Katherine Dandy Wins Appeal at First Department  

In a unanimous decision, issued on June 7, 2018, the Appellate Division reversed the trial court’s denial of summary judgment in a case involving failure to timely diagnose a thoracic meningioma.  Ms. Dandy drafted the appellate briefs and Ms. Ruddy argued the case before the First Department.
